1. Description of Service

House Design AI is an AI-powered interior and exterior design application that allows you to:

• Upload photos of rooms, homes, or spaces
• Select design styles, room types, color palettes, and provide custom prompts
• Generate AI-powered redesigns of your spaces
• Save, share, and manage your design generations
• Browse furniture and decor product recommendations matched to your designs

2. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you are at least 13 years old. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Accounts

When you use the App, an anonymous account is created automatically. You do not need to provide a username or password. Your account is identified by a unique anonymous identifier managed through our backend service.

You are responsible for maintaining the security of your device and access to the App. We recommend that you do not jailbreak or root your device, as this may compromise the security of your account and the App's functionality.

4. Subscriptions and Payments

The App offers both free and premium (Pro) features:

• Free Tier: Limited daily design credits that reset each day.
• Pro Subscription: Unlimited designs, no watermarks, and premium features. Available as weekly, monthly, yearly, or lifetime purchases.

Subscriptions are processed through the Apple App Store (iOS) or Google Play Store (Android). By purchasing a subscription, you agree to the payment terms of the respective platform:

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel subscriptions through your device's App Store or Play Store settings.
• Any unused portion of a free trial period will be forfeited when you purchase a subscription.

Refund requests must be directed to Apple or Google, as applicable, in accordance with their refund policies. We do not process refunds directly.

5. User Content

"User Content" refers to photos, images, prompts, and other content you upload or submit through the App.

• Ownership: You retain ownership of any photos you upload. We do not claim ownership of your original photos.
• License: By uploading content, you grant us a limited, non-exclusive, worldwide license to use, process, and store your content solely for the purpose of providing the Service (generating designs, displaying results, caching for performance).
• No Training: We do not use your photos to train AI models. Your photos are only processed to generate your requested designs.
• Responsibility: You are solely responsible for the content you upload. You represent that you have the right to upload and use any photos you submit.

You must not upload content that is illegal, infringes on third-party rights, contains explicit or harmful material, or violates any applicable laws.

6. AI-Generated Content

The App uses third-party AI services (including Google Gemini and OpenAI) to generate design images. Regarding AI-generated content:

• No Guarantees: AI-generated designs are provided "as is." We do not guarantee the accuracy, quality, suitability, or realism of any generated design.
• Variability: AI outputs may vary each time, even with the same inputs. Results are not deterministic.
• Not Professional Advice: AI-generated designs are for inspiration and visualization purposes only. They do not constitute professional interior design, architectural, or structural advice. Always consult qualified professionals before making structural or significant changes to your property.
• Usage Rights: Subject to these Terms, you may use AI-generated designs for personal, non-commercial purposes. Commercial use of generated designs may be subject to the terms of the underlying AI service providers.
• Product Recommendations: Product suggestions shown alongside designs are for reference only. Prices, availability, and specifications may change without notice.

7. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Upload content that infringes on intellectual property rights of others
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's servers or networks
• Use automated systems, bots, or scripts to access or interact with the App
• Attempt to circumvent subscription or credit limitations
• Create multiple accounts to abuse free credits
• Upload inappropriate, explicit, or harmful content
• Use the App to generate content that is defamatory, harassing, or threatening
• Resell, redistribute, or commercially exploit the App or its content without authorization

8. Intellectual Property

The App, including its design, features, code, graphics, logos, and all related intellectual property, is owned by Syed Fahim Anwer / Syeds Co and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App or its content, nor may you reverse engineer or attempt to extract the source code.

9. Third-Party Services

The App uses third-party services that have their own Terms and Conditions:

• Google Play Services
• Apple Standard EULA
• RevenueCat
• Sentry
• Meta (Facebook)
• Google Gemini API
• OpenAI

10. Internet Connectivity

The App requires an active internet connection to function fully. Features such as generating AI designs, syncing your account, and loading product recommendations require connectivity. Some features (viewing cached designs) may work offline.

We are not responsible for the App not functioning at full capacity if you do not have internet access. If you use the App outside your home territory, roaming charges from your mobile network provider may apply. You accept responsibility for any such charges.

11. Account Termination

You may delete your account at any time through the App's settings. Upon deletion, all your data including photos, generations, and account information will be permanently removed from our servers.

We reserve the right to suspend or terminate your account if you violate these Terms, engage in abusive behavior, or use the App in a manner that could harm other users or our services. Accounts found to be banned will lose access to all App features and stored content.

12. Disclaimers

THE APP AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the App will be uninterrupted, secure, or error-free; (b) AI-generated designs will be accurate, complete, or suitable for any purpose; (c) any defects will be corrected; or (d) the App will be compatible with all devices or operating systems.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SYED FAHIM ANWER, SYEDS CO, OR ANY OF OUR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless Syed Fahim Anwer, Syeds Co, and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the App; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another party.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Delhi, India.

16. Updates to the App

We may update the App from time to time, including for bug fixes, new features, and security improvements. Some updates may be delivered over-the-air (OTA) without requiring an App Store update. We recommend keeping the App updated to the latest version for the best experience and security. We reserve the right to stop supporting older versions of the App at any time.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. For significant changes, we may provide notice through the App. Your continued use of the App after any changes constitutes acceptance of the new Terms.
